StockCharts.com, Inc. (“StockCharts.com,” “we,” “us,” “our”) has created this Privacy Statement in order to demonstrate our commitment to the privacy of those that visit and use our website (“Users,” “you,” “your”). This Privacy Statement applies to the personal information that we process when you access or use products, services, and resources provided by StockCharts.Com, including our Site at https://stockcharts.com/ (the “Site”), mobile application (the “App”), and Content (as defined below), and any updates and changes to the foregoing (collectively, the “Services”). and this Privacy Policy is incorporated into and forms a part of the Terms of Service, together with all other terms and policies linked or otherwise referenced within the Terms of Service (available at https://help.stockcharts.com/learning-more/policies-and-limitations/terms-of-service). Capitalized terms used and not otherwise defined herein shall have the meanings provided in the Terms of Service.

The European Union, the United Kingdom, and California require additional information regarding our privacy practices and your privacy rights under the data privacy laws of those states. If you are a California resident, please see the section titled “Your Rights And Choices Regarding Your Information” below.

By visiting or using the Site or Services, you are accepting and consenting to the practices described in this Privacy Statement. If you have any objections to the Privacy Statement, you should immediately discontinue use of the Site and Services. We may change this Privacy Statement from time to time in accordance with the Terms of Service. We encourage you to review the Privacy Statement whenever you access our websites or otherwise interact with us to stay informed about our information practices.

1. What Personal Information StockCharts.com Collects

As used in this Privacy Statement, “Personal Information” means information that can be used to identify (directly or indirectly) or to contact an individual, and which qualifies as “personal data” or “personal information” subject to data privacy laws applicable to us. “Personal Information” may include, but is not limited to, your first and last name, your unique user ID, email address, and other information about yourself that you choose to submit through our Services. The term “Personal Information” does not include aggregate or de-identified information unless it is linked with your other Personal Information.

a. Registration and Purchases/Renewals

In order to access the membership areas of the site, a User is required to give contact information, including name and email address. We use this information to ensure account security and uniqueness and to contact the User in case a problem occurs. We may use the User's email address to provide customer support, or to administer and maintain their account. In addition, registered Users must provide payment information (such as credit card number and expiration date). This information is used for billing purposes. Payment information is transmitted directly to our payment processor and never actually stored in StockCharts.com's systems.

b. Real-Time Data Subscriptions

If you choose to subscribe to one of our real-time data plans, the exchange which provides the real-time data requires us to collect certain Personal Information from you and report that information to the exchange. This may include your name, address, occupation, name and address of your employer, and basic job title/position/function information. This information is used to verify whether or not you are a financial professional, as we are not allowed to provide real-time data to financial professionals.

c. Website Notification Features

If you choose to receive promotional, marketing, or other e-mails from us, you must provide your email address. This may include, but is not limited to, subscribing to the ChartWatchers Newsletter, signing up for notifications of new blog articles, or setting up technical alerts. If you choose to be notified of technical alerts via SMS, you will be required to provide your mobile phone number. This contact info is used to send the requested notifications to the User, and for our other promotional and marketing purposes.

d. Other Email Communication Features

The Services allow Users to send information (including charts and blog articles) to others via email. Additionally, our Public ChartList feature optionally allows Internet Users to contact you via email by filling out a web-based form; Users can also share annotated charts and commentary with the rest of the Internet via our Public ChartList feature, blog article comments, message boards, and online forums. You should exercise discretion with regard to what Personal Information you post on public areas of our Services and you should not post highly confidential or sensitive information. StockCharts.com is not responsible for how third parties who view your Personal Information on these public areas of the Services may use this information (such as to send you unsolicited messages).

e. Profile Information

When a User customizes their StockCharts.com account, those customized User settings (default chart settings, favorite lists, etc.) are collected and stored in their profile. StockCharts.com does not use stored User settings for marketing purposes. Profiles are used for the purpose of customizing our paying Users' visits.

f. Web Server Log Files

Like most websites, we use web server log files. Records in our log files include internet protocol (IP) addresses, browser types, referring pages, exit pages, platform types, and date/time stamps. We use web server log files to administer the Services, to provide broad traffic information for Services planning purposes, to ensure that our Terms of Service agreement is being adhered to, and for the other purposes specified below.

2. How StockCharts.com Utilizes Your Information

StockCharts.com may use Personal Information to facilitate your use and our administration and operation of the Services, to provide you with information or services you request, and to learn more about and improve the Services, including by:

  • setting up and manage User accounts and otherwise establishing and managing your use of the Services;

  • processing subscription transactions;

  • providing customer service;

  • sending account- or transaction-related communications, or service-related announcements;

  • send you newsletters, RSS feeds, text messages, and/or other promotional or marketing communications or services that you have signed up for or otherwise agreed to receive;

  • allowing you to participate in interactive features of our Services;

  • keeping our Services safe and secure;

  • manage our systems and improve the Services;

  • developing, customizing, and improving the Services (including without limitation diagnosing technical and service problems, administering our Services; performing research and analysis aimed at improving our products, services and technologies);

  • display content customized to your interests or preferences;

  • identifying and protecting against fraud, prohibited or illegal activities, as well as potential third-party claims and other liabilities; and

  • generally complying with applicable laws, rules, and regulations.

We also may share your Personal Information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of StockCharts.com, the Services, our users, or others; to prevent and protect StockCharts.com and its users from fraudulent, abusive, unlawful, or unauthorized use of the Services; to otherwise enforce our rights and agreements; and otherwise in connection with our Terms of Service and other agreements with you, in each case as permitted by applicable laws. In such cases, we reserve the right to raise or waive any legal objection or right available to us at our discretion.

We will only use your Personal Information in the ways we specified when it was collected (including as described in this Privacy Statement). We may use non-personal information (including but not limited to Personal Information that has been de-identified and/or aggregated) for any reason at our sole discretion.

3. Use of Cookies and Automatic Information Gathering Technologies

a. Cookies

StockCharts.com uses both session ID cookies and persistent cookies to provide Users with a customized experience for the Services. We use a session cookie to control access to our membership areas. Once you close your browser, the session cookie is deleted.

A persistent cookie is a small text file stored on your hard drive for an extended period of time. Persistent cookies can be removed by following your browser's help file directions. We use persistent cookies to store your customized user interface preferences. You can usually modify your browser settings to decline cookies. If you reject the use of session ID or persistent cookies, you will not be able to access the paid areas of StockCharts.com and you will no longer be able to customize your user interface preferences; however, you will still be able to use the free areas of the Services.

b. Web Beacons and Other Activity Tracking Technologies

When you access and use our Services, we (and our advertisers and ad networks providing services to us) may use various activity tracking technologies, such as web beacons, pixels, cookies and similar tracking technologies, to collect information about your use of our Services, our emails, or our ad content. You can control the use of cookies at the individual device or browser level.

The ads appearing on the Services are delivered to Users by Publisher First, Inc. (“Freestar”), our web advertising partner. Information about Users' visits to the Services, such as the number of times they have viewed an ad is used to serve ads to Users on this Services, and may be collected and used for the purpose of interest-based advertising, ad targeting, and delivery optimization. 4. Third Parties With Whom StockCharts.com May Share User Information

We may disclose Personal Information to:

  • employees, companies, agents, contractors, service providers or others engaged to perform functions on our behalf, and otherwise to assist us in providing the Services and related services. These individuals and companies are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements;

  • our business partners, merchants, investors, potential buyers, and other third parties as permitted by data protection laws;

  • government authorities if we are required to do so by law, regulation, or legal process (such as a court order or subpoena), in response to requests by government agencies, such as law enforcement authorities; and/or if we have a good faith belief that the disclosure is necessary or appropriate to comply with law or legal process;

  • our marketing partners and service providers for purposes of “cross-context behavioral advertising,” or targeted advertising regarding StockCharts.com's Services. For more information about our sale or use of Personal Information for targeted advertising, please see the section titled “Your Rights and Choices Regarding Your Information” below.

Additionally, StockCharts.com reserves the right to sell or transfer information (including your Personal and non-Personal Information) to a third party as part of, or during negotiations of, a sale, merger, or transfer of all or substantially all of the assets of our company, or in the event of a bankruptcy, liquidation, or receivership of our business, and you hereby consent to any such sale or transfer.

5. Your Responsibilities; Updating Personal Information

You acknowledge and agree that you, not StockCharts.com, are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all Personal Information that you submit, and for ensuring that any Personal Information that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Services, the information you receive when using the Services, and our ability to contact you.

When you use our Services, we make a good faith effort to provide you with access to your Personal Information and to either correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We provide a way for Users to update their Personal Information on our Services. Paying members can update their information on the “Your Account” page. For newsletter subscriptions and other types of Services notifications, Users can change their email address simply by unsubscribing the old email address and re-subscribing using the new email address. Users can change their mobile phone number by editing an alert that uses SMS notification on the Technical Alert Workbench. Alternately, Users can send an email to privacy@stockcharts.com and request updates or changes to Personal Information. Please note that even if you opt out of receiving e-mails from StockCharts.com, you may still receive relationship e-mails from us, including responses to e-mails that you sent to us prior to opting out, notices of updates or changes to our policies and procedures, or other messages relating to your account or your use of the Services.

6. Opting Out

Users can opt out of providing certain Personal Information by not registering for the Services; however, they may not be able to use all the features of the Services. Additionally, Users who have registered for an account for our Services cannot opt out of certain mandatory types of email communications (e.g. service announcements and account administration emails), but they can deactivate their account if they no longer wish to receive such communications. All promotional or marketing email communications are optional (e.g. newsletter mailings, blog notifications, or technical alerts). Users can opt out of these communications using the unsubscribe link included at the bottom of the email. They can also opt out by contacting privacy@stockcharts.com. We ask individual Users to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical.

7. Data Storage and Security

StockCharts.com takes reasonable administrative, technical, and physical precautions to protect our Users' Personal Information from accidental or unlawful destruction, loss, theft, copying, or unauthorized disclosure, access, use, or modification. We protect our Users' Personal Information using industry-standard SSL encryption.

Unfortunately, however, no data transmission over the Internet and no method of data storage can be guaranteed to be 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security. You are responsible for all uses of the Services by any person using your account, and for keeping the User ID and password you use for accessing our Services confidential. We ask you not to share your account information with anyone. We strongly recommend that you do not re-use an existing password as the password for your StockCharts.com account.

8. Data Retention

We reserve the right to retain Personal Information collected about you for as long as necessary to fulfill the purpose(s) for which it was collected, such as to enable or improve your access to or use of the Services, and otherwise as necessary to comply with applicable laws and our legal obligations (including business, legal, or tax purposes), resolve disputes with any parties, and otherwise as needed to provide the Services that you have requested. We strive to destroy personal information once it is no longer necessary in accordance with applicable laws.

9. “Sale” and “Sharing” of Personal Information

State privacy laws require that we notify you if we use your Personal Information for “targeted advertising”; this includes the CCPA, which requires that we provide transparency about Personal Information we “sell” or “share.” As used herein, “sale” means a transaction in which we disclose Personal Information of a resident of California to third parties in exchange for valuable consideration. “Targeted advertising” or “sharing” means selecting advertisements based on Personal Information obtained from activities of a consumer subject to applicable state privacy laws across unaffiliated websites to display certain advertisements to that consumer.

StockCharts.com does not knowingly sell or “share” Personal Information about consumers under the age of 16. From time to time, we may “share” certain Personal Information for cross-context behavioral advertising. In the 12 months preceding the date on which this Privacy Statement was last updated, we have “shared” the following categories of Personal Information with the following categories of third parties:

10. Your Rights and Choices Regarding Your Information

Personal Information gathered through the Services may be transferred, used, and stored in the United States and in any foreign jurisdictions in which we, our agents, service providers, customers, and other Users are located. If you use the Services, you consent to the transfer, use, and storage of your Personal Information to and in those jurisdictions. If you are located in certain states in the United States or in the European Union or the United Kingdom, you may have privacy rights under the law of your jurisdiction.

a. EU/UK Data Subject Rights

For Users who reside in the EU, Switzerland, or the UK, and who are subject to any one of (i) the General Data Protection Regulation, (ii) data protection laws implemented by member states of the EU in harmony with the General Data Protection Regulation, or (iii) the UK Data Protection Act of 2018, as amended and incorporated into UK law (collectively, the “GDPR”), we have implemented the practices described below to provide you with control over any Personal Information that constitutes “Personal Information” under the GDPR. If you are not an EU Data Subject, the provisions below do not apply to you.

  1. Lawful Grounds. We rely on the following lawful grounds under the GDPR to process your Personal Information: (a) it is necessary for the performance of a contract with you; (b) our or a third-party’s legitimate business interest; or (c) your consent.

  2. Data Transfer Notice. We are located in the United States and transfer your Personal Information for processing in the United States. We make the transfer to the United States in the absence of an adequacy decision because it is necessary for the performance of a contract with you, or with your consent.

  3. Individual Rights and Data Requests. We provide tools to our Users to access, transfer, rectify or erase their Personal Information, or to restrict the processing of their Personal Information. You may also contact us at privacy@stockcharts.com to request access to, transfer of, and rectification or erasure of your Personal Information, or restriction of processing, or to object to processing of your Personal Information. Please specify the nature of your request and the information that is the subject of your request. We may require you to submit additional information necessary to verify your identity and status as a data subject. If we are processing your Personal Information based upon the lawful ground of your consent, you have the right to withdraw your consent for such processing at any time without affecting the lawfulness of processing based on consent before it is withdrawn.

  4. Retention. At a minimum, we will retain your Personal Information for as long as necessary for the purpose in which it was collected such as to perform a contract, for our or a third-party’s legitimate interest, or your consent.

We will respond to all data subject requests directly within the time period required by applicable law.

The California Consumer Privacy Act (Cal. Civ. Code § 1798.100 et seq.), as amended by the California Privacy Rights Act (collectively “CCPA”) affords consumers residing in California certain rights with respect to their Personal Information. We do not use or disclose sensitive Personal Information for the purpose of inferring characteristics about you. We retain Personal Information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Privacy Statement. We will delete Personal Information in accordance with our standard document retention schedules.

c. Privacy Rights in California

If you are a resident of California, you may have rights to request access to specific information, data portability and deletion, as described below. These rights are not absolute, and in some instances, we may decline your request as permitted by law.

1. Access to Specific Information and Data Portability. You can request the following information about how we have collected and used your Personal Information during the past 12 months:

  • The categories of Personal Information we collected about you.

  • The categories of sources for the Personal Information we collected about you.

  • The business or commercial purpose for which we collected your Personal Information.

  • The categories of third parties with whom we share the Personal Information.

  • A copy of the specific pieces of Personal Information we collected about you (also called a data portability request).

2. Deletion/Correction. You can request that we delete or correct the Personal Information that we collect from you.In addition to the rights above, you have the right to exercise your rights free from discrimination prohibited by the CCPA.

d. Exercising Data Subject Rights

Under the CCPA, consumers have the right to know what Personal Information we have collected about them, to request that we provide access, correct, or delete their Personal Information, that their Personal Information be provided in portable form, and non-discrimination for their exercise of any of the rights provided to them under law. Residents of California are entitled to request to exercise their rights as a consumer or a data subject up to twice in a 12-month period. We may charge a reasonable fee for excess requests in the same 12-month period, as permitted by applicable law.

To exercise the rights available to you as a data subject under applicable laws, as described above, submit a request to us by either: emailing us at privacy@stockcharts.com or 1-888-241-2270. We will need to verify your identity (and, where applicable, your authorized agent’s authority to make the request on your behalf) as well as other information about you to process your request. You may only make a verifiable request twice within a twelve-month period. We will not discriminate against you for exercising any of your rights regarding your information.

11. Opt-Out Preference Signals

Some browsers allow you to enable privacy controls in the browser’s settings to automatically signal your opt-out preference to the websites you visit (e.g., Global Privacy Control). As of the date on which this Privacy Policy was last updated, however, there is no standardized opt-out preference signal. As such, our Services do not currently respond to browser-based opt-out preference signals. If you do not wish to be tracked, you may be able to opt out by selecting certain options in the settings of the browser or device that you use to access the Services, or by using third-party applications and programs.

12. Minors

We do not knowingly collect Personal Information from individuals under 13 years of age, nor do we authorize persons who are less than 13 years old to use the Services. If we learn from the individual or from the individual's parent or legal guardian that we have collected Personal Information about a person under the age of 13, we will delete their Personal Information from our systems as required by law.
